The conditions of this Agreement apply to any saddles, including replacement saddles, rented from NeddyUp.

Renter will rent the saddle for the rental period shown on the Agreement.  NeddyUp may agree to extend this rental period.

If Renter does not post the saddle back on time he/she is breaking the conditions in the Agreement.  NeddyUp can charge Renter for every day or part-day Renter has the saddle after he/she should have returned it to NeddyUp.  NeddyUp will charge Renter at the contracted rate until it gets the Saddle back.

Renter’s responsibilities

• Renter must look after the saddle and any accessories.  Renter must always securely store the saddle when he/she is not using it

• Renter is responsible for any damage of the saddle.

• Renter must not sell, rent or dispose of the saddle.  Renter must not give anyone any legal rights over the saddle.

• Renter takes full responsibility on the saddle whilst not being used directly by the Renter. 

• Renter must let NeddyUp know as soon as he/she becomes aware of any defect(s) in the saddle.

• Renter’s liability for damage and theft shall begin on delivery of the saddle.  Renter is responsible for ensuring the saddle is fully insured.

• Renter will have to pay for repairs if the saddle needs more than NeddyUp’s standard cleaning and leather treatment (if applicable).

• Renter must take responsibility for ensuring that the saddle is returned to NeddyUp through a recorded delivery service.

3. NeddyUp’s responsibilities

NeddyUp has maintained the Saddle to at least the manufacturer’s recommended standard.  NeddyUp undertakes that the saddle is in good condition and suitable for riding.  NeddyUp will identify and agree any existing damage with Renter on the Rental Condition Report.

NeddyUp take no responsibility if someone is injured or dies as a result of using the saddle.

NeddyUp is responsible for losses suffered by Renter as a result of NeddyUp’s breach of the Agreement where such losses are a foreseeable consequence of the breach in the circumstances of the case.  NeddyUp is not responsible for indirect losses which happen as a side effect of the main loss or damage which are not foreseeable by NeddyUp and Renter (such as loss of profits or loss of opportunity)

Conditions for using this saddle

 Renter or any authorised user must not:

• Use the saddle for hire or reward.
• Use the saddle for any illegal purpose.
• Take the saddle outside of the United Kingdom unless NeddyUp has given Rider written permission.

 Charges

Renter will pay the following charges:

• A deposit amount equivalent to the monthly rental price.  The deposit will be refunded upon termination of the agreement and return of goods in an acceptable condition.  The deposit amount cannot be used as part or full payment towards rental charges.

• The rental charge and any other optional charges at the rates shown on the Agreement.

• Any charge for loss or damage resulting from non-compliance with Clause 2.

• On demand, the full cost of repairing or replacing the saddle if it is damaged or stolen (even if it is not the Renter’s fault). 

• Any published rates for delivering the saddle (renter must arrange postage for saddle return).

• Interest which NeddyUp will add every day to any amount Renter does not pay NeddyUp on time, at the rate of 4% a year above the base lending rate of National Westminster Bank Plc from time to time.

On demand, NeddyUp’s costs, including reasonable legal fees where permitted by law, incurred in collecting payments due from the Renter under the Agreement.
